En "Sobre un presunto derecho a mentir por filantropía", Kant expone el deber incondicionado de veracidad, que ha sido problemático para la filosofía kantiana porque parece obligar a las personas a ser veraces en todas sus declaraciones, sin importar si son comunicaciones públicas o privadas. Llamaré extensiva a la interpretación que sostiene la obligación de ser veraces en todas las declaraciones y mostraré que es causa de inconsistencias con la Doctrina del Derecho. Las inconsistencias se resuelven con una interpretación restrictiva (...) de este deber: la obligación de veracidad es aplicable solo a las comunicaciones públicas. Si mi interpretación es correcta, todas las comunicaciones públicas, ya sean hechas por ciudadanos o funcionarios, tienen la obligación de ser veraces, pero no en las privadas. Mi interpretación es consistente con el resto de los textos donde Kant habla de la comunicación pública. (shrink)

This book brings together a number of researchers of different nationalities to reflect on religion and philosophy in ancient Greece. These scholars have been convened by the Brazilian research group Delphos and discuss, in particular, how religious and philosophical thought intertwined during this period. Among the papers collected here, several are devoted to epic and philosophical literature before Plato. The others deal, alongside this great classical philosopher, with Aristotle and Philo of Alexandria. These contributions allow us to recognise how the (...) vision of the cosmos, metaphysics and human life are intertwined in Greek thought. A journey is made from traditional Greek religion to its philosophical reinterpretations, reaching as far as the monotheistic God of Judaism made known in the Hellenic language. The nature of the cosmos, investigated scientifically, is no stranger to the Greeks' view of the divine, but neither is ethics, with all its demands. Thus, these studies provide a kaleidoscopic view of the various points of view from which nature, the human condition and divinity are approached through the eyes of ancient Greek literature. The objective of the research is to carry out a review of the literature about suicide risk factors in young university students. The methodology used is quantitative descriptive with a bibliometric approach, under the PRISMA method. The search was carried out in three databases: Clarivate Web of Science, MDPI and Taylor and Francis that had the variables of suicide risk factors. Inclusion criteria were used such as: study variables, years 2019 to 2022, published in Spanish and English,scientific reports research results, (...) research with clinical and non-clinical population. After the application of the Boolean operators, the total sample is (n=10360) and after screening with the PRISMA method (n=45). Results: The United States, followed by China and Bangladesh, are the countries that produce the most on the subject. The most frequent risk factors are: depression, anxiety, stress, academic commitments, lack of opportunities, low income and race. The students with the highest suicide rates are in the health area such as medicine and nursing, in addition, there is more suicide intent in women than in men. (shrink)

Within ordinary ---unitary--- quantum mechanics there exist global protocols that allow to verify that no definite event ---an outcome to which a probability can be associated--- occurs. Instead, states that start in a coherent superposition over possible outcomes always remain as a superposition. We show that, when taking into account fundamental errors in measuring length and time intervals, that have been put forward as a consequence of a conjunction of quantum mechanical and general relativity arguments, there are instances in which (...) such global protocols no longer allow to distinguish whether the state is in a superposition or not. All predictions become identical as if one of the outcomes occurs, with probability determined by the state. We use this as a criteria to define events, as put forward in the Montevideo Interpretation of Quantum Mechanics. We analyze in detail the occurrence of events in the paradigmatic case of a particle in a superposition of two different locations. We argue that our approach provides a consistent single-world picture of the universe, thus allowing an economical way out of the limitations imposed by a recent theorem by Frauchiger and Renner showing that having a self-consistent single-world description of the universe is incompatible with quantum theory. In fact, the main observation of this paper may be stated as follows: If quantum mechanics is extended to include gravitational effects to a QG theory, then QG, S, and C are satisfied. (shrink)

Jorge Portilla argues that authentic philosophical inquiry plays a liberating function. This function is that of bringing more fully to consciousness aspects of identities or ways of being‐in‐the world that have been, up until then, tacit or opaque to the agent herself to facilitate her endorsement, rejection, or modification of these identities. For Portilla, this function facilitates greater self‐mastery by increasing the range of free variations of subjectivity available to the agent, and this increase in self‐mastery itself constitutes a (...) kind of liberation. The main goal of this article is to provide a substantive interpretation of the nature of liberation Portilla thinks is embedded in this central function of authentic philosophical inquiry. I argue that this type of liberation should be understood ultimately in terms of increases in human agency, so I label it “agential liberation.” For Portilla, agential liberation involves two central elements: (i) a type of agential flourishing central to human flourishing, and (ii) an increase in the reach of intentional action that I describe as an expansion in the arena of human agency. Call ‘a substance’ a person who is at home in a relatively stable and unified sense-making framework: a social structure that to some degree specifies which categories are important for interpreting reality, which goals are worth pursing, which character traits are admirable, etc. Call ‘an accident’ a person who is not at home in one such framework. It is tempting to think that being a substance is preferable, but I present some considerations for thinking otherwise. Mexican philosophers Emilio Uranga and (...) Jorge Portilla, I argue, present notions of accidentality as decolonial tools. Uranga’s account enables Mexicans to have positive valuation of their being independently of the approving gaze of the colonizers and their standards of value. Portilla’s thought distinguishes between pernicious accidentality resulting from the disintegration of sense-making frameworks and authentic accidentality as a condition for freedom, self-creation, and ultimately for individual and communal liberation. This paper addresses the relationship between logic and phenomenology at a historical moment that precedes the big divide between analytic philosophy and phenomenology. In analysing alternative derivations of phenomenological logic, the discussion focuses on the case of two notorious neo-Kantian Mexican philosophers from the first half of the XXth century: Adalberto García de Mendoza and Francisco Larroyo. It is argued that both García de Mendoza and Larroyo made an original contribution to the discussion on the relationship between phenomenology (...) and logic. Further, this paper attempts to present a charitable portrait of both García de Mendoza and Larroyo in contrast to underrating approaches to both Mexican philosophers. In so doing, this paper adopts a historical—though not strictly biographical— perspective. While it is true that neither García de Mendoza nor Larroyo could be considered “phenomenologists” or “Husserl scholars” according to contemporary standards it is worth noticing that they engage in the discussion of phenomenological logic. Both authors had the project of developing a grounding logic for science and, as the article argues, both attempts could be even linked. Their project, however, was unfinished. The plan of this paper is as follows. The first section addresses the problem of the relationship between logic and phenomenology. The second one focuses on García de Mendoza’s contributions. The third one elaborates on Larroyo’s Logic of Sciences. And, finally, the fourth section elaborates on these Mexican philosophers’ contributions to education, making as well further observations concerning the similarities and differences between both authors. From the thought of mid-twentieth century Mexican philosopher Jorge Portilla, I develop an account of what I call ‘ethics of ethnic identity,’ which include: a) a set of norms of agency grounded in ethnic identity, or ethnic norms of agency—reasons for action and obligations that spring from a given ethnic identity, and b) a type of normativity governing these ethnic norms of agency. I argue that one of the theoretical advantages of this account is that it fares well with (...) respect to human flourishing, moral obligations, and freedom and autonomy. I also develop an account of ethics of ethnic identity from Christine Korsgaard’s account of the sources of normativity and use it as a sophisticated foil against which my elaborations of Portilla’s views can be fruitfully contrasted. Can a person from Latin America be a Catholic, or a feminist, or a democratic socialist in an authentic way? These identities come from Europe, and given the colonial history of Latin America, it seems reasonable to think that decolonizing the Latin American mind is a condition for its authenticity. Further, it seems reasonable to think that decolonization itself requires extirpating ideas and identities originating from the colonizers, especially those used to establish the colonial order. Thus, it seems that Latin (...) Americans cannot adopt such identities; authentic decolonization demands otherwise. In this paper I argue that the thought of twentieth century Mexican philosopher Jorge Portilla provides a persuasive account of the nature of authentic self-creation that allows for a kind of decolonization that makes it conceptually possible for Latin Americans to be Catholics, feminists, or democratic socialists in an authentic fashion. That is, authentic decolonization of the mind, I argue, need not involve a blanket rejection of identities originating from the colonizers; instead, it can be understood as a particular kind of authentic self-creation: one that is appropriately sensitive to the colonial history of the identities freely chosen by the agent. El trabajo somete a discusión algunos elementos y argumentos del ensayo "Anti-Nietzsche. La crueldad de lo político" de Jorge Polo Blanco. Analizo el libro de Polo considerando el problema de la diversidad de caracterizaciones parciales que obtiene la figura de Nietzsche en el pensamiento filosófico contemporáneo y el desafío que supone actualizar a Nietzsche a la luz de nuestras sensibilidades democráticas. Examino los capítulos del libro apuntando algunas de las incorrecciones y aspectos más dudosos de su argumentario “anti-nietzscheano” e (...) incidiendo en la importancia del estudio de fuentes (Quellenforschung) y de la historia de las ediciones de la obra de Nietzsche para una interpretación filosófica rigurosa. I examine the different chapters and identify some of the inaccuracies and most dubious aspects of Polo’s “anti-Nietzschean” argument. For many years I have maintained that I learned to philosophize by translating Francisco Suárez’s Metaphysical Disputation V from Latin into English. This surely is a claim that must sound extraordinary to the members of this audience or even to most twentieth century philosophers. Who reads Suárez these days? And what could I learn from a sixteenth century scholastic writer that would help me in the twentieth century? I would certainly be surprised if one were to find any references to (...) some of Suárez’s works in any of the works of twentieth-century major philosophers. One of the reasons for my claim is the great difficulty I had in figuring out what Suárez’s text means and how to render it understandable to English readers. Translating the text forced me to think in ways that were quite different from those I was used to think in Spanish, my native tongue, or English, my adoptive tongue. In fact, the translation I produced after having completed many drafts continued, and still continues to this day, to appear to me unsatisfactory, and that dissatisfaction was the key to understanding things I had understood very differently before. I hope to make clear why in what follows. The thesis that I defend is that semantic equivalence between texts of philosophy in different languages is difficult, if not impossible in some cases, to achieve and, therefore, that it is a mistake to restrict doing analytic philosophy to English, as Gustavo Rodríguez-Pereyra argues we should do in a recent article (2013). En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. Mimesis can refer to imitation, emulation, representation, or reenactment - and it is a concept that links together many aspects of ancient Greek Culture. The Western Greek bell-krater on the cover, for example, is painted with a scene from a phlyax play with performers imitating mythical characters drawn from poetry, which also represent collective cultural beliefs and practices. One figure is shown playing a flute, the music from which might imitate nature, or represent deeper truths of the cosmos based upon (...) Pythagorean views (which were widespread in Western Greece at the time). The idea that mimesis should be restricted to ideals was made famous by Plato (whose connections to Pythagoreanism and Siracusa are well-known), and famously challenged by his student Aristotle (not to mention by the mimetic character of Plato’s own poetry). This volume gathers essays not only on the philosophical debate about mimesis, but also on its use in architecture, drama, poetry, history, music, ritual, and visual art. Esta investigación retoma la obra de Gabriel García Márquez, Noticia de un secuestro (1996), con la volición de cuestionar la idea de Estado nación que está inmersa en el libro. Para ello, es necesario entender que la naturaleza del texto exige un conocimiento amplio al lector o al intérprete, puesto que su contenido revela datos multidisciplinarios. Además, es insoslayable realizar un análisis discursivo de la historia de ese contexto y cotejar con pasajes del mismo libro. Para facilitar esta labor, (...) la extrapolación de conceptos del teórico Luis Rodríguez Manzanera será de utilidad, ya que él despliega definiciones de Criminología, un tema frecuente en la obra. Verbigracia, la macrocriminalidad, una noción que él postula, permite que se comprenda la complexión del periodo histórico finisecular del siglo XX en Colombia, etapa que le corresponde a Noticia de un secuestro. Por otro lado, es menester dilucidar que este estudio no se reduce a lo literario, lo histórico y lo criminológico, sino que abarca distintas disciplinas, por lo que la exigencia en la consolidación epistemológica e interpretativa estará demostrada consuetudinariamente, sin obviar la inmanencia de la obra. Este tipo de análisis interdisciplinarios ya ha sido trabajado desde los Estudios Culturales, tal como se constata en las investigaciones de Richard Johnson (2000) o Néstor García Canclini (1997). De igual modo, el intento de establecer lineamientos y conexiones entre disciplinas como las de Literatura y Derecho ya ha sido desarrollado por Stanley Fish (1986), Faustino Martínez (2005), Carlos Pérez (2006) y Denise Schalet (2014). A diferencia de estos abordajes ya estudiados, el objetivo de esta investigación es detectar y fundamentar cómo se articula una propuesta ideológica desde una configuración que reanuda elementos históricos y literarios. En específico, lo que se busca es argumentar por qué fracasó implícitamente un proyecto sociopolítico de democracia y progreso, a partir de un panorama de violencia, narcoterrorismo, corrupción, negociaciones ilícitas, transgresión a los derechos humanos e inseguridad ciudadana. Con todo ello, esta tesis de maestría terminará siendo fructuosa para análisis postremos de discursos que tienen como esencia un soporte multidisciplinario. (shrink)

En el presente trabajo sostenemos que la teoría de la competencia que Rodríguez postula en su Teoría Analítica del Derecho (TAD) adolece de algunos problemas. El primero de ellos consiste en ser un enfoque reduccionista de la competencia (similar al de Bulygin y el de Ferrer), en el cual la competencia queda reducida a reglas determinativas que determinan potestades. Es dudoso que la competencia pueda reducirse a un único tipo de norma y el mismo Rodríguez parece albergar dudas (...) a este respecto. El segundo problema consiste en el rechazo que Rodríguez hace de la idea misma de regla constitutiva. Dicho rechazo a su vez se basa en un rechazo más general: el de las tesis de Searle sobre las reglas constitutivas. Sostenemos que rechazar las tesis de Searle no implica el tener que rechazar el concepto de regla constitutiva, que el problema de la competencia puede explicarse de una manera más completa acudiendo a la noción (ligeramente reformulada) de regla eidético-constitutiva de Amedeo Conte y que esto permite construir un sistema de normas que constituya de manera completa la competencia de los agentes jurídicos. A este tipo de sistemas lo llamamos “sistema constitutivo” y creemos que su implementación permite considerar un enfoque de la competencia más completo que el ofrecido en TAD, resolver la ambivalencia que Rodríguez parece tener frente a su propio enfoque y rescatar la idea de regla constitutiva de la condena que Rodríguez le aplica. Noticia de un secuestro (1996), del Premio Nobel de Literatura Gabriel García Márquez, representa a la sociedad colombiana que atraviesa por un período caracterizado por el desarrollo de actos narcoterroristas, del cual se detecta el funcionamiento de Pablo Escobar —jefe del Cartel de Medellín— hacia el Gobierno. El presente artículo tiene como finalidad hallar aquellos referentes que permiten ubicar esta obra literaria en lo histórico y lo social —definidos desde la percepción del criminólogo Luis Rodríguez Manzanera al precisar (...) sobre la forma delictiva y la tensión provocada en la ciudadanía para denominarlas como macrocriminalidad—, junto con lo político-filosófico (el capitalismo definido desde el marxismo-leninismo) y lo literario —considerando el posboom como una manifestación artística que permite la incorporación de elementos propios de los Estudios Culturales; como, por ejemplo, la articulación de lo nacional y la crítica ideológica al sistema que los impera. Los estudiantes de la Facultad de Ciencias Económicas y de Administración de la Universidad de la República deben realizar, como trabajo final de carrera, una investigación o ensayo monográfico en un área de su interés, tutorados por un docente universitario o un investigador de reconocida trayectoria. Un gran número de estos trabajos monográficos han hecho un aporte valioso al conocimiento pero, lamentablemente, la poca difusión de éstos hace que ese conocimiento termine olvidado en los fondos de la biblioteca de la (...) Facultad, entre cientos de producciones monográficas. Se pretende en este libro, mostrar los aportes que se han generado en el área tanto de Economía de la Cultura como de Gestión de Organizaciones Culturales. Varias de las monografías fueron realizadas en la línea de investigación Costos y Gestión de Organizaciones Culturales, la cual coordino. Otros fueron realizados con antelación, como los trabajos tutorados por el referente de la Economía de la Cultura en Uruguay, el hoy fallecido Luis Stolovich. También se incluyen dos trabajos monográficos tutorados por el Dr Gustavo Buquet, quien siempre está presente a la hora de crear investigación de calidad en Economía de la Cultura. Como cada trabajo supera el centenar de páginas, no es posible publicarlos completamente, por lo que para este libro se hicieron resúmenes de esos trabajos, intentando adecuar la terminología y quitándoles el formato estrictamente científico –poco amigable para un no especialista-, de forma tal que su lectura sea accesible al público en general. Se resumieron ocho, clasificados en tres capítulos: Patrimonio, Artes Escénicas e Industria Cultural. El capítulo de Patrimonio comienza con un trabajo realizado por las Economistas Fernanda Arezo y Verónica Pereyra, titulado “Museos y Ciudadanos, el comportamiento del consumidor”, tutorado por Raúl Ramírez y por mí. Este estudio tuvo como centro explicar la modalidad de conducta de consumo del visitante montevideano hacia tres importantes instituciones museísticas como lo son el Museo del Cabildo, el Museo del Carnaval y el Museo de Historia del Arte. El objetivo del trabajo es estimar la demanda y obtener un indicador de la propensión a pagar por el consumo de dichos museos. El segundo trabajo, titulado “Disposición a pagar por la restauración de la Puerta de la Ciudadela”, fue realizado por las Contadoras Beatriz Torres, María Elena Olarán y María Carolina Duarte, y tutorado en forma conjunta por el Phd. Juan José Goyeneche y quien les escribe. En este trabajo se realiza una valoración contingente para medir la disposición a pagar por la restauración de la “Puerta de la Ciudadela”, un monumento fundamental de identidad montevideana. El capítulo de Patrimonio finaliza con un trabajo realizado por las Economistas Malena Rodríguez y María de la Paz Besada y tutorado por el Ec. Luis Stolovich. El mismo se denomina “El arte uruguayo: un estudio sobre el mercado y la pintura como alternativa de inversión” y explora el mercado de arte uruguayo, analizando la rentabilidad de la inversión en pintura uruguaya. Tratan la rentabilidad de la inversión para tres casos específicos: las obras vendidas por el Banco Comercial en su proceso de recuperación de activos, un portafolio de obras de Pedro Figari y otro de Joaquín Torres García. En cuanto al segundo capítulo, Artes Escénicas, comienza con un trabajo realizado para la obtención del título de Contador Público realizado por Pamela Cambeiro, Martín Cami e Ignacio Mouradián. Se denomina “La gestión de teatros. Caso de estudio: Aplicación del Cuadro de Mando Integral al Teatro Solís” y trata sobre la identificación de indicadores que faciliten las tareas de gestión para la dirección del Teatro. Luego se presenta un trabajo realizado por las Economistas Tania Cruz y Natalia Nollenberger titulado “Análisis económico del teatro independiente en Montevideo: una aproximación al problema de la fatalidad de los costos”. Este trabajo, también tutorado por el Ec. Luis Stolovich, muestra un exhaustivo análisis del teatro independiente montevideano identificando los problemas económicos que afectan al sector. El capítulo de Industria Cultural incluye tres trabajos. El primero, fue realizado por el Economista Diego Traverso y tutorado por el Dr. Gustavo Buquet, y su título es “Análisis de competitividad del sector exportador de Productoras Audiovisuales Publicitarias en Uruguay”. El sector audiovisual publicitario es un sector dinámico que se ha internacionalizado tempranamente y que generó divisas para el país del orden de los US$ 24 millones durante el año 2005 por concepto de exportaciones. En este trabajo se caracteriza al sector audiovisual publicitario en Uruguay y se analiza las ventajas competitivas que posee frente a sus principales competidores extranjeros. El segundo trabajo fue realizado por las Contadoras Natalia Rivera, Antonella Triay y María Eugenia Triay y se denomina “Gestión aplicada a las empresas radiales”. En este se identifican el sector radial, su proceso productivo y la complejidad al definir al “cliente”. Se proponen una serie de indicadores con el doble objetivo de medir el desempeño de la empresa y proveer incentivos a su organización. Finalmente, el último trabajo monográfico, fue una investigación interdisciplinaria, que sirvió simultáneamente para obtener el título de Licenciado en Economía a Ernesto Pienika y el de Licenciado en Administración a Nicolás Cohnheim y a Damián Geinsinger. Este trabajo, tutorado por el Dr. Gustavo Buquet y el Cr. Cecilio García de título “Impactos de las nuevas tecnologías en la .industria musical”, muestra cuáles son los principales impactos en esa industria que las nuevas tecnologías han provocado y cuáles son las posibles estrategias para adaptarse a estos cambios, así como los nuevos modelos de negocio. Espero que este libro sea el primero de una larga lista. Las áreas de Economía de la Cultura y Gestión de Organizaciones Culturales son disciplinas jóvenes que necesitan seguir creciendo. La investigación realizada por trabajos monográficos de fin de carrera en estas áreas, será siempre bienvenida. (shrink)

En el trabajo se hace un recorrido por los principales autores latinoamericanos que trabajan el tema de los valores en el siglo XX. Se trata de apresar algunas regularidades generales en el itinerario del pensamiento axiológico en América Latina durante la pasada centuria.

El artículo analiza el papel del resentimiento en la Teoría de los sentimientos morales de Adam Smith y su conexión con el proceso de la simpatía mutua por medio del cual el “espectador imparcial” asume plenamente el resentimiento de la víctima, al considerar que su pasión se rige por los principios de la propiedad y la justicia. Se sostiene que el resentimiento no solo cumple un rol central en la teoría del castigo de Adam Smith, en la medida en que (...) permite retribuir, disuadir y rehabilitar al victimario sino que, además, aporta a la discusión contemporánea sobre el perdón y la reconciliación, pues convoca la posibilidad de superar el resentimiento y restablecer las relaciones sociales entre el agresor y la víctima. 1. The Bundle Theory I shall discuss is a theory about the nature of substances or concrete particulars, like apples, chairs, atoms, stars and people. The point of the Bundle Theory is to avoid undesirable entities like substrata that allegedly constitute particulars. The version of the Bundle Theory I shall discuss takes particulars to be entirely constituted by the universals they instantiate.' Thus particulars are said to be just bundles of universals. Together with the claim that it is necessary that (...) particulars have constituents, the fundamental claim of the Bundle Theory is: (BT) Necessarily, for every particular x and every entity y, y constitutes x if and only ify is a universal and x instantiates y. 2 The standard and supposedly devastating objection to the Bundle Theory is that it entails or is committed to a false version of the Principle of Identity of Indiscernibles (Armstrong 1978: 91, Loux 1998: 107), namely: (Pll) Necessarily, for all particulars x and y and every universal z, if z is instantiated by x if and only if z is instantiated byy, then x is numerically identical with y. The most famous counterexample to the Identity of Indiscernibles is that put forward by Max Black, consisting of a world where there are only two iron spheres two miles apart from each other, having the same diameter, temperature, colour, shape, size, etc (Black 1952: 156). Let us from now on think of the properties of the spheres in this world as universals. The possibility of this world, which I shall hereafter refer to as 'Black's world', makes (Pll) false.' And according to common philosophical opinion this means that the Bundle Theory is false.. (shrink)

I defend a Deferred Ostension view of quotation, on which quotation-marks are the linguistic bearers of reference, functioning like a demonstrative; the quoted material merely plays the role of a demonstratum. On this view, the quoted material works like Nunberg’s indexes in his account of deferred ostensión in general. The referent is obtained through some contextually suggested relation; in the default case the relation will be … instantiates the linguistic type __, but there are other possibilities. In this way, the (...) deferred ostension view deals with a problem I pointed out for the identity proposal in my earlier work, that we do not merely refer with quotations to expression-types, but also to other entities related in some way to the relevant token we use: features exhibited by the token distinct from those constituting its linguistic type, features exhibited by other tokens of the same type but not by the one actually used (as when, by using a graphic token, we refer to its phonetic type), or even other related tokens (see the examples on p. 261 of García-Carpintero 1994). When a circular coin is rotated in depth, is there any sense in which it comes to resemble an ellipse? While this question is at the center of a rich and divided philosophical tradition (with some scholars answering affirmatively and some negatively), Morales et al. (2020, 2021) took an empirical approach, reporting 10 experiments whose results favor such perspectival similarity. Recently, Burge and Burge (2022) offered a vigorous critique of this work, objecting to its approach and conclusions on both philosophical (...) and empirical grounds. Here, we answer these objections on both fronts. We show that Burge and Burge’s critique rests on misunderstandings of Morales et al.’s claims; of the relation between the data and conclusions; and of the philosophical context in which the work appears. Specifically, Burge and Burge attribute to us a much stronger (and stranger) view than we hold, involving the introduction of “a new entity” located “in some intermediate position(s) between the distal shape and the retinal image.” We do not hold this view. Indeed, once properly understood, most of Burge and Burge’s objections favor Morales et al.’s claims rather than oppose them. Finally, we discuss several questions that remain unanswered, and reflect on a productive path forward on these issues of foundational scientific and philosophical interest. (shrink)

Die sprachliche und soziale Natur der Erkenntnis ist eine Grundeinsicht der Moderne. Doch welchen Spielraum lässt sie noch der Kritik, der distanzierten Prüfung der eigenen Sprache und Lebensform? Vor dem Hintergrund des Werkes Stanley Cavells fragt dieses Buch nach dem Verhältnis von Lebensform und Selbsterkenntnis. In ungewohnter Weise liest es Wittgenstein und Foucault als komplementäre Antwortstrategien auf dieses Grundproblem: Philosophie muss als eine "Arbeit an sich", als körperliche "Selbsttechnik" verstanden werden. Nicht ethische Programmatik, so kann gezeigt werden, sondern systematische Konsequenz (...) führt zu einer Engführung von Philosophie und Lebenspraxis. (shrink)

Our pains can be more or less intense, our mental imagery can be more or less vivid, our perceptual experiences can be more or less striking. These degrees of intensity of conscious experiences are all manifestations of a phenomenal property I call mental strength. In this article, I argue that mental strength is a domain-general phenomenal magnitude; in other words, it is a phenomenal quantity shared by all conscious experiences that explains their degree of felt intensity. Mental strength has been (...) largely overlooked in favor of mental states’ type, representational contents, domain-specific phenomenology, or processes such as attention. Considering mental strength in our reflections about the mind illuminates debates about the relation of representational contents and phenomenal character, and it also helps address questions about the structure and functions of consciousness. Mental strength provides a unifying construct to model what is shared in the phenomenology of different types of conscious experiences. (shrink)

In this chapter, we discuss a selection of current views of the neural correlates of consciousness (NCC). We focus on the different predictions they make, in particular with respect to the role of prefrontal cortex (PFC) during visual experiences, which is an area of critical interest and some source of contention. Our discussion of these views focuses on the level of functional anatomy, rather than at the neuronal circuitry level. We take this approach because we currently understand more about experimental (...) evidence at this coarse level and because these results are appropriate for arbitrating between current theoretical frameworks. We discuss the Two-Visual-Systems Hypothesis (Milner & Goodale 1995; 2006), Local Recurrency (Lamme 2010; Lamme 2006), Higher Order (Lau 2008; Lau & Rosenthal 2011) and Global Workspace theories (Baars 1997; Baars 2005; Dehaene & Naccache 2001; Dehaene 2014). Despite the apparent stark differences between conscious and unconscious perceptual processing, available evidence suggests that their neural substrates must be largely shared. This indicates that the difference in neural activity between conscious and unconscious perceptual processing is likely to be subtle and highly specialized. We argue that current experimental evidence about the involvement of specific activity in prefrontal cortex supports the higher order neural theory of consciousness. In consequence, imaging techniques that focus only on marked differences between conscious and unconscious level of activity are likely to be insensitive to the relevant neural activity patterns that underlie conscious experiences. Finally, it follows from the evidence we discuss that the functional advantages of conscious over unconscious perceptual processing may be more limited than commonly thought. (shrink)

Arguably the most foundational principle in perception research is that our experience of the world goes beyond the retinal image; we perceive the distal environment itself, not the proximal stimulation it causes. Shape may be the paradigm case of such “unconscious inference”: When a coin is rotated in depth, we infer the circular object it truly is, discarding the perspectival ellipse projected on our eyes. But is this really the fate of such perspectival shapes? Or does a tilted coin retain (...) an elliptical appearance even when we know it’s circular? This question has generated heated debate from Locke and Hume to the present; but whereas extant arguments rely primarily on introspection, this problem is also open to empirical test. If tilted coins bear a representational similarity to elliptical objects, then a circular coin should, when rotated, impair search for a distal ellipse. Here, nine experiments demonstrate that this is so, suggesting that perspectival shapes persist in the mind far longer than traditionally assumed. Subjects saw search arrays of three-dimensional “coins,” and simply had to locate a distally elliptical coin. Surprisingly, rotated circular coins slowed search for elliptical targets, even when subjects clearly knew the rotated coins were circular. This pattern arose with static and dynamic cues, couldn’t be explained by strategic responding or unfamiliarity, generalized across shape classes, and occurred even with sustained viewing. Finally, these effects extended beyond artificial displays to real-world objects viewed in naturalistic, full-cue conditions. We conclude that objects have a remarkably persistent dual character: their objective shape “out there,” and their perspectival shape “from here.”. (shrink)

I argue racial injustice undermines the reliability of news source reports in the information domain of racial injustice. I argue that this in turn undermines subjects’ doxastic justification in inferences they base on these news sources in the racial injustice information domain. I explain that racial injustice does this undermining through the effect of racial prejudice on news organizations’ members and the effect of society's racially unjust structure on non-dominant racial group-controlled news sources.

Throughout its history, analytic philosophy has established a decidedly anti-rhetoric self-understanding. Yet the historical development of analytic philosophy, leading from Russell to Quine and Davidson, successively puts this anti-rhetorical ideals in question. Even though the rhetorics of clarity and objectivity remain, the discussions of post-analytic philosophy focus more and more an an understanding of language which is forced to acknowledge its irreducible practical and situational aspects. Analytical philosophy, then, should be seen as a decidedly anti-rhetoric tradition which tries to keep (...) up the spirit of scientific enlightenment in times of growing skepticism -- and which is driven, by the very force of clarity and a better understanding, to develop a picture of language which undermines this ideal at least in some aspects. Ultimately this book provides a theory of intergenerational justice that is both intellectually robust and practical with wide applicability to law and policy.

The core idea of 'becoming major', as it can be found in Kant's famous essay about the Enlightenment, is the concept of self-legislation or self-governance. Minority is described as a state of dependency on some heteronomous guidance (i.e. church, doctor, or the state), whereas majority is defined by Kant as the ability to guide oneself, using one's own understanding ('Verstand'). These definitions display a deep affinity to central concepts of Kant's philosophy: the autonomy of rational ethics, as it is defended (...) in the second Critique, and the copernican revolution in epistemology, which is the topic of the first Critique. Picking up on these similarities, the text isolates some of the essential conditions for Kant's understanding of an enlightened state of majority. Kant's theoretical works spell out conceptual preconditions for his radical account of self-guidance and gives it a more detailed form. This allows to articulate some of the historical assumptions and theoretical implications of majority which we might have lost out of sight in a time where 'self-management' is a ubiquitous demand. According to one of Leibniz's theories of contingency a proposition is contingent if and only if it cannot be proved in a finite number of steps. It has been argued that this faces the Problem of Lucky Proof , namely that we could begin by analysing the concept ‘Peter’ by saying that ‘Peter is a denier of Christ and …’, thereby having proved the proposition ‘Peter denies Christ’ in a finite number of steps. It also faces a more general but (...) related problem that we dub the Problem of Guaranteed Proof . We argue that Leibniz has an answer to these problems since for him one has not proved that ‘Peter denies Christ’ unless one has also proved that ‘Peter’ is a consistent concept, an impossible task since it requires the full decomposition of the infinite concept ‘Peter’. We defend this view from objections found in the literature and maintain that for Leibniz all truths about created individual beings are contingent. (shrink)

Introspection is a fundamental part of our mental lives. Nevertheless, its reliability and its underlying cognitive architecture have been widely disputed. Here, I propose a principled way to model introspection. By using time-tested principles from signal detection theory (SDT) and extrapolating them from perception to introspection, I offer a new framework for an introspective signal detection theory (iSDT). In SDT, the reliability of perceptual judgments is a function of the strength of an internal perceptual response (signal- to-noise ratio) which is, (...) to a large extent, driven by the intensity of the stimulus. In parallel to perception, iSDT models the reliability of introspective judgments as a function of the strength of an internal introspective response (signal-to-noise ratio) which is, to a large extent, driven by the intensity of conscious experiences. Thus, by modelling introspection after perception, iSDT can calibrate introspection’s reliability across a whole range of contexts. iSDT offers a novel, illuminating way of thinking about introspection and the cognitive processes that support it. I present a novel position vis-à-vis the views in the Latin American philosophy literature regarding whether subjects more aptly use "Hispanic" or "Latinx" to refer to Hispanic- or-Latinx people. To this end, I will argue (C) the term "Afro-Latinx" is more apt than "Hispanic" or "Latinx" in a significant number of cases. This conclusion is based on three premises. The first premise (P1) is that use of "Afro-Latinx" provides subjects with understanding of how certain events depend on anti-Black racism, US (...) society's racially unjust structure and US colonial policy. The second premise (P2) is that that neither the term "Hispanic" nor the term "Latinx" provide subjects with this understanding of how certain events depend on anti-Black racism, US society's racially unjust structure and US colonial policy. The third premise (P3) is that the term "Afro-Latinx" provides subjects with more understanding of these events than the terms, "Hispanic" and "Latinx.” I present three cases which feature the experiences of Afro-Dominican people. The 1992 murder of Dominican man Kiko García by New York Police officer O’Keefe is first case. The second case is the Washington Heights Uprising that ensued Kiko García’ murder. An instance where a nightclub bouncer in the Dominican Republic denies a Dominican women entry because of her hair texture composes the third case. (shrink)

I argue that Bartolomé de las Casas and Juan Ginés de Sepúlveda differed in their conclusions regarding the status of Indigenous persons at least partly because las Casas had significant, yet incomplete, understanding of Indigenous persons, culture and societies and Sepúlveda had mere knowledge of them. To this end, I show that the epistemic state of understanding explains why Las Casas properly concluded that Indigenous persons deserve the same moral status afforded to Europeans. And I show how las Casas’ understanding (...) of Indigenous persons, culture and societies related to what he got wrong about Indigenous persons. (shrink)

Metacognition is the capacity to evaluate the success of one's own cognitive processes in various domains; for example, memory and perception. It remains controversial whether metacognition relies on a domain-general resource that is applied to different tasks or if self-evaluative processes are domain specific. Here, we investigated this issue directly by examining the neural substrates engaged when metacognitive judgments were made by human participants of both sexes during perceptual and memory tasks matched for stimulus and performance characteristics. By comparing patterns (...) of fMRI activity while subjects evaluated their performance, we revealed both domain-specific and domain-general metacognitive representations. Multivoxel activity patterns in anterior prefrontal cortex predicted levels of confidence in a domain-specific fashion, whereas domain-general signals predicting confidence and accuracy were found in a widespread network in the frontal and posterior midline. The demonstration of domain-specific metacognitive representations suggests the presence of a content-rich mechanism available to introspection and cognitive control. (shrink)

The concept of shared mental models refers to the shared understanding among team members about how they should behave in different situations. This article aimed to develop a new shared mental model measure, specifically designed for the refereeing context. A cross-sectional study was conducted with three samples: national and regional football referees (n = 133), national football referees and assistant referees and national futsal referees (n = 277), and national futsal referees (n = 60). The proposed version of the Referee (...) Shared Mental Models Measure (RSMMM) has 13 items that are reflected on a single factor structure. The RSMMM presented good validity evidence both based on the internal structure and based on relations to other variables (presenting positive associations with team work engagement, team adaptive performance, and team effectiveness). Such promising psychometric properties point to an optimistic outlook regarding its use to measure shared mental models in futsal and football referee teams. -/- . (shrink)

Rescue workers have a stressful and risky occupation where being engaged is crucial to face physical and emotional risks in order to help other persons. This study aims to estimate work engagement levels of rescue workers (namely comparing nurses, firefighters, and police officers) and to assess the validity evidence related to the internal structure of the Portuguese versions of the UWES-17 and UWES-9, namely, dimensionality, measurement invariance between occupational groups, and reliability of the scores. To evaluate the dimensionality, we compared (...) the fit of the three-factor model with the fit of a second-order model. A Portuguese version of the instrument was applied to a convenience sample of 3,887 rescue workers (50% nurses, 39% firefighters, and 11% police officers). Work engagement levels were moderate to high, with firefighters being the highest and nurses being the lowest engaged. Psychometric properties were evaluated in the three-factor original structure revealing acceptable fit to the data in the UWES-17, although the UWES-9 had better psychometric properties. Given the observed statistically significant correlations between the three original factors, we proposed a 2nd hierarchal structure that we named work engagement. The UWES-9 first-order model obtained full uniqueness measurement invariance, and the second-order model obtained partial (metric) second-order invariance. (shrink)

Analytic philosophy of language has often criticized classical pragmatism for holding to an unwarranted notion of experience which lapses into epistemological foundationalism; defenders of the classics have denied such a consequence. The paper tries to move this debate forward by pointing out that the criticism of the empiricist “given” is not wedded to a specific philosophical method, be it linguistic or pragmatist. From a broader historical perspective drawing in particular on Kant, antifoundationalism turns out to be deeply rooted in modern (...) western philosophy and its ambivalent attitude towards the success of the empirical sciences. This diagnosis allows to reassess classical pragmatism beyond the perceived alternative “language vs. experience”, and to concentrate on antifoundationalism as the real challenge to any modern, epistemologically oriented philosophy. In that perspective, classical pragmatism’s genuine contribution is to do justice to antifoundationalism by focusing on the experimental dynamic of scientific practice, which is most commonly ignored by the analytic tradition. Pragmatism identifies rationality with the practical operation of reflexively determining and articulating what is being experienced. With this approach, it is argued, experiential pragmatism serves modern antifoundationalism ends better than its analytic siblings. (shrink)

Sostenemos la tesis de que el concepto de hegemonía que desarrolló Gramsci es deficiente en dos puntos claves: en dar cuenta de los modos de integración característicos de las sociedades complejas, y en su proyección respecto a la construcción de la sociedad futura. Los dos aspectos están relacionados en cuanto que uno y otro remiten a la concepción de una totalidad ética, vertebrada por una concepción del mundo. El concepto de hegemonía, según esto, debiera superar su honda dimensión eticista. In French post-structuralism, »decentering« signifies the criticism of any metaphysical »centre« which is supposed to reign the development and the logic of discourse, and hence of thinking. In particular, anthropology and the recourse to humanism were suspected to miss the plurality and the self-differing nature of discursive practices. This article presents Dewey’s philosophy as an alternative to this criticism. Dewey is comparably sceptical of any attempt to treat the human being as a metaphysical essence. Nevertheless, he develops an explicit humanism (...) which defends the central values of freedom, openness, and growth. This paradoxical humanism is rendered possible by developing a concept of nature, and the human being, which,decenters‘ the specific human capacities by consequently treating them as an integral part of nature. The article offers a close reading of chapter 6 of Dewey's 'Experience and Nature'. It explains how Dewey reformulates the classical notion of the subject in pragmatist terms, emphasizing in particular Dewey's idea that 'experience' is not a priori subjective, but rather has to be appropriated by the acting individual in order to become one's own experience in an emphatic sense.

The so-called ›resolute‹ reading of Wittgenstein, most notably represented by Cora Diamond and James Conant, claims that the text of the Tractatus does not convey a philosophical thesis. In engaging with the text and its literary form, the reader is supposed to cultivate an experience which will eventually allow her to confront (moral) reality without any obstructing philosophical abstractions. The article argues that this under- standing of the text implicitly rests on the traditional and highly problem- atic distinction between rhetoric (...) and ›serious‹ speech, between a use of language which describes facts and one which elicits experiences. By re- constructing the alleged effect of a ›resolute‹ reading of the Tractatus with the help of Iser’s theory of literary experience, it is shown that the ›real- ism‹ that the resolute readers argue for can have no substance at all. O objetivo deste trabalho é desafiar as correntes tradicionais da bioética, que fundamentam ideais abstratos de imparcialidade, cidadania universal e autonomia absoluta; confrontá-los a partir do conhecimento situado e do reconhecimento da matriz de dominação interseccional vigente na América Latina. Procura investigar como transformar múltiplas desigualdades, repolitizando a justiça interseccional, a agência política em momentos críticos de progresso e colonização dos nossos bens comuns. Nossa proposta final é uma bioética crítica interseccional, representativa e participativa, que inclua de forma não subordinada (...) as vozes e os conhecimentos dos outros, focada em nossas necessidades regionais, promovendo nossa autonomia relacional e o cuidado com a vida, em e para nossos territórios, comunidades e as gerações futuras. Studying the neural correlates of conscious awareness depends on a reliable comparison between activations associated with awareness and unawareness. One particularly difficult confound to remove is task performance capacity, i.e. the difference in performance between the conditions of interest. While ideally task performance capacity should be matched across different conditions, this is difficult to achieve experimentally. However, differences in performance could theoretically be corrected for mathematically. One such proposal is found in a recent paper by Lamy, Salti and Bar-Haim [Lamy (...) D, Salti M, Bar-Haim Y. Neural correlates of subjective awareness and unconscious processing: an ERP study. J Cognitive Neurosci 2009,21:1435-46], who put forward a corrective method for an electroencephalography experiment. We argue that their analysis is essentially grounded in a version of High Threshold Theory, which has been shown to be inferior in general to Signal Detection Theory. We show through a series of computer simulations that their correction method only partially removes the influence of perfor- mance capacity, which can yield misleading results. We present a mathematical correction method based on Signal Detection Theory that is theoretically capable of removing performance capacity confounds. We discuss the limitations of mathemati- cally correcting for performance capacity confounds in imaging studies and its impact for theories about consciousness. (shrink)

There is a relationship between touch and language at the heart of which lies the philosophical problem of the secret. As Derrida points out, since Aristotle touch has been qualified as ἄδηλον: secret, nocturnal, barely apparent. After some brief etymological remarks, in this article, I explore the mystery that touch represents for language through Levinas’ concept of the secret, thematizing two levels: first, that of the contemporary critique of ocularcentrism, then the level of the tactile experiences that can hardly be (...) put into words.
